Information about processing of personal data

At whom is this information addressed?

In accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. 2016 No. 119, p. 1) TECHKO Sp. z o.o. informs that the following provisions apply to individuals conducting a business activity, persons representing contractors and recipients of benefits who are legal persons or organisational entities entity not possessed of legal personality granted a legal capacity by a statut, attorneys-in-fact (including persons for contact/realization of an agreement/order), whose data has been made available to TECHKO Sp. z o.o. in connection with the conclusion of agreement.

Who is your data controller?

Your personal information is controlled by TECHKO Sp. z o.o. with the registered seat in Warsaw, Wilcza 18/21, 00-532 Warsaw („TECHKO”).

From where do we have your data?

• directly from you, as the person representing the entity entering or wishing to enter into the contract;
• from an entity that has an agreement with TECHKO;
• from partner/third party cooperating with TECHKO, who has provided your personal data on the basis of your permission;
• from publicly available sources, e.g. from the National Court Register, Central Business Activity Records and Information or other similar sources.

Which data do we process?

1. contact details;
2. data required for identification purposes for the conclusion or execution of the contract and issuing of the invoice;
3. data required for recruitment or signature of agreement;
4. the data needed to select the right offer for you;
5. data required to take participation in tender;
6.  other available data relating to necessary actions for the execution of legal obligations or processing the order/agreement between you and TECHKO.

For what we will use your personal data?

We will process your personal data for one or more of the following purposes:

• processing of actions performed at your request before entering into a agreement;
• concluding and executing the agreement which you have concluded with TECHKO;
• executing the agreement concluded with TECHKO in your favour as third party (art. 393 the Polish Civil Code), when the contracting party is another entity;

• fulfilling a legal obligation upon TECHKO, e.g. issuing an invoice or bill.

Are you obliged to provide your personal data?

To the extent that we process your data for the purpose of participating in a tender and executing a agreement with us, your data is provided as a condition for concluding this agreement and participating in the tender. Data provision is optional, but necessary to participate in the tender and to conclude and execute an agreement.

If personal data is not provided, the contract will not be concluded. Providing the data necessary for issuing an invoice is a legal obligation and it results from the „Polish Law on the tax on goods and services”.

In other respects, the providing of personal data is optional, is not a legal requirement or agreement and is not a condition for the conclusion of a agreement.

How to cancel my permission or correct the personal data which are provided?

At any time you may cancel permission which you have given to Techko Sp. z o.o. or correct the data provided in accordance with processing of personal data without any negative consequencesJust send an e-mail to info@techko.eu or send a letter by post at our office address (Robotnicza 5 St., 02-261 Warsaw, Poland). Cancellation of permission does not affect the legality of the processing your data before it was done, i.e. until you canceled your permission the processing of your data by  TECHKO is legal.

On what basis will we process your personal data?

The basis for the processing of personal data are depends by executed activity:

• concluding and executing the agreement with TECHKO.;
• fulfilling a legal obligation upon TECHKO (e.g. issuing an invoice);
• your permission.

When and to whom can we share your data, and to whom will we definitely not share it?

We may share your data with recipients, i.e. companies that cooperate with us and carry out tasks for and on our behalf.

In this case, an agreement with these entities is concluded to ensure the security of your data. Because these entities change often, we are unable to provide you with a complete list, if you wish to know who we are currently working with TECHKO, you can always ask.

Instead, we will not transfer your personal data to a third country (outside of the European Economic Area).

What rights do you have when you provide personal data to TECHKO?

You have the right to request from TECHKO access to your personal data, rectification/correction, removal or restriction of processing, and we may transfer it to another entity at your request.

Till when will we keep your data?

Your personal data will be stored as long as it is necessary for the execution of the contract between you and TECHKO or a contract concluded by another entity on your behalf, after this time for a period of time matching the period of limitation of actions that TECHKO may be liable for and  responsibilities that may be required from
TECHKO.

If your personal data will be processed in order to fulfill a legal obligation upon the Administrator, the personal data will be kept for the time necessary for the fulfillment of this obligation.

Data processed on the basis of permission will be processed until you cancel that permission.

If your personal data will be processed on the basis of the legally justified reason of the Administrator, when the basis of this processing is the execution of a concluded agreement with TECHKO in your favour, data will be processed until the fulfilling of legal obligations resulting by law of the basis of such processing.
